When a homeowner dies or has moved out of the house and the home is no longer OWNER-OCCUPIED can an insurance company deny a homeowner claim? Yes, an insurance company can deny a homeowner claim if a home is no longer OWNER-OCCUPIED. This could mean a recent death or the owner simply moving out. If the home will become a RENTAL property then call your agent and REWRITE to a dwelling fire policy, meaning cancel the homeowners and start a new rental property policy.
